Wyoming car accident statute of limitations: a long clock, short exceptions

The Wyoming car accident statute of limitations gives you four years. Call free to check your date.

Wyoming allows four years to sue for injuries and for damage to your car, under W.S. 1-3-105. Two exceptions are far shorter. Death claims and claims against a government body get only two years.

The Wyoming limits that run shorter

A wrongful death action must start within two years after the death, under W.S. 1-38-102. Crashes with a state, county or town vehicle need an itemized written claim within two years, under W.S. 1-39-113. The claim must list the time, place, what happened and the amount sought.

When the Wyoming clock waits

A hurt child can sue within three years after turning 18. If the normal four years end later, that date wins, under W.S. 1-3-114.

If the other driver leaves Wyoming or hides, the clock does not run while they are gone, under W.S. 1-3-116.

Splitting the blame in Wyoming

Wyoming compares your fault to the total fault of every actor, including people not in the lawsuit. You recover if your share is 50 percent or less, under W.S. 1-1-109. The jury is told what its percentages will do to your award and your damages drop by your share.

Wyoming insurance and when to call a car accident lawyer

Wyoming is at-fault and drivers need at least $25,000 per person, $50,000 per crash and $20,000 for property, under W.S. 31-9-102. Car damage claims of $6,000 or less can use the small claims process, under W.S. 1-21-201. The court rules set a $10 filing fee.

Injury claims are larger and harder to price. An attorney can value the claim, find extra coverage and file well inside four years. The call is free and the lawyer is paid only if you win.
