Kentucky car accident statute of limitations under the no-fault law
Find your date under the Kentucky car accident statute of limitations with a free call to a lawyer.
Kentucky’s usual injury deadline is only one year, but car crashes get more time. Under the Motor Vehicle Reparations Act, you have two years from the injury or from the last no-fault payment, whichever is later, under KRS 304.39-230. Damage to your car has its own two years.
The deadlines in Kentucky

| Car or property damage lawsuit | Two years | KRS 413.125 |
| Shared fault | Pure comparative: award cut by your share, no bar | KRS 411.182 |
| Minimum liability cover | $25,000 / $50,000 / $25,000 | KRS 304.39-110 |
| No-fault (PIP) benefits | $10,000 per person | KRS 304.39-020 |
Why Kentucky seems to have two injury deadlines
Kentucky’s general rule gives one year for an injury, under KRS 413.140. Crash claims covered by the no-fault law get two years instead. Those two years can run from the last PIP payment, so the date your insurer last paid a bill matters.
Kentucky’s no-fault threshold
Your own policy pays up to $10,000 per person in basic reparation benefits, also called PIP, under KRS 304.39-020. You can sue for pain and suffering only past a threshold, under KRS 304.39-060. Medical expenses must top $1,000 or the injury must be a broken bone, permanent harm, disfigurement or death.
Drivers may reject these limits on suing in writing before a crash, under that same section. If you or the other driver did, the rules change, so dig out your policy papers.
Kentucky splits fault without a cutoff
Kentucky juries give each person a percentage of fault and your award drops by your share, under KRS 411.182. No share bars you. At 70 percent fault, you can still collect 30 percent of your loss.
Each driver must carry at least $25,000 per person, $50,000 per crash and $25,000 for property, under KRS 304.39-110. Serious injuries often outrun those limits.
