Georgia diminished value can be claimed from either insurer. Georgia's supreme court ruled in 2001, in State Farm v. Mabry, that insurers must assess lost value on their own customers' claims too.

The formula

The 17c formula comes from the Mabry case and the settlement after it. It caps the starting figure at 10 percent of the car's value. Georgia's claims rule also caps deductions for prior damage at 20 percent of value.

A repaired $28,000 car with moderate damage and 30,000 miles gives $1,120 by the 17c formula.

The deadline

A lawsuit for damage to property must be filed within four years, under Georgia Code 9-3-32. Injury claims have two years.

Newest change: Georgia passed tort reform on April 21, 2025, and it changed injury trials, not car-value claims.

How to file with their insurer
