Kansas car accident statute of limitations: two years and a PIP threshold

The Kansas car accident statute of limitations gives you two years. Call free to check your date.

Kansas is a no-fault state with a two-year deadline. Before you can claim pain and suffering, your medical treatment must be worth $2,000 or the injury must be serious, under K.S.A. 40-3117. The two years for injury and car damage come from K.S.A. 60-513.

The Kansas no-fault threshold

Your own PIP cover pays first, with medical benefits of at least $4,500 per person, under K.S.A. 40-3103. PIP stands for personal injury protection and it pays no matter who caused the crash.

To sue the other driver for pain and suffering, you need medical treatment worth $2,000 or more. A broken weight-bearing bone, a permanent injury or disfigurement also qualifies, under 40-3117. That limit is about pain damages, not your car.

When the Kansas clock pauses or bends

A child’s claim can be filed up to one year after turning 18, if that is later than the usual two years. But no such claim may come more than eight years after the crash, under K.S.A. 60-515.

Claims against a city or county start with a written notice to its clerk or governing body. You then wait up to 120 days for an answer before suing, under K.S.A. 12-105b.

Shared fault and minimums in Kansas

Kansas lets you recover only if your negligence was less than the other side’s, under K.S.A. 60-258a. An even 50-50 split pays nothing. At 20 percent fault, a $25,000 loss pays $20,000. Every driver must carry at least $25,000 per person, $50,000 per crash and $25,000 for property, under K.S.A. 40-3107.

When to call a Kansas car accident lawyer

Call once your medical bills near $2,000 or a doctor mentions a fracture or lasting harm. That is the point where a full injury claim may open up. An attorney can then build the case well before the two years end. No fee is owed for the call and the lawyer is paid only if you win.
