A total loss settlement pays what your car was worth the moment before the crash, not what you paid or owe. In California the offer must match a comparable car, plus taxes and transfer fees, under 10 CCR 2695.8.
How they set the total loss value
The insurer runs your car's year, trim, options and miles through a valuation service, then compares recent sales nearby. Georgia's rule caps deductions for prior damage and poor condition at 20 percent of the car's value, per rule 120-2-52.
Disputing a low number
- Get the full valuation report in writing.
- Check every option, the trim and the mileage it lists.
- Find three listings of cars like yours for sale nearby.
- Send them with a short letter asking for a new figure.
A 2019 sedan valued at $14,200 against three nearby listings averaging $16,000 is $1,800 short.
Newest change: Texas auto policies issued or renewed after January 1, 2026 must have an appraisal clause, under SB 458, per TDI Bulletin B-0012-25.
If you still owe on it
The insurer pays your lender first, up to the loan balance. If the car was worth less than the loan, you owe the gap. Gap coverage, if you bought it with the car, pays that difference.
Claiming lost value instead
